RPRA: Distribution of 2023 Tires Settlement Funds

RPRA has finalized a methodology to distribute the funds from the May 2025 settlement agreement between RPRA’s Registrar and eTracks on behalf of 29 of their producer clients that did not meet their 2023 minimum collection requirements under the Tires Regulation.

The settlement funds – $7.4M minus administrative costs – will be disbursed directly to eligible tire producers using the distribution methodology approved by the Registrar. Registered tire producers that achieved or exceeded their 2023 minimum collection requirements will be eligible to receive a share of the settlement funds to help offset their resource recovery costs.

The settlement and distribution of funds to eligible producers holds producers that failed to meet their recycling requirements under the Tires Regulation accountable by imposing $7.4M in penalties and promotes Provincial Interests related to the tire recycling market outlined in the Resource Recovery and Circular Economy Act, 2016 by leveling the playing field between tire producers that failed to meet their minimum collection requirements and those that met or exceeded the requirements.

RPRA engaged tire producer responsibility organizations (PROs) between September and October 2025 to inform the development of the distribution methodology and retained PricewaterhouseCoopers Canada as the fund administrator to facilitate the distribution of the settlement funds.

The settlement fund payments will be issued to eligible producers starting in Q2 2026 and is anticipated to be completed in Q4 2026. Any remaining settlement funds not able to be distributed may be transferred by the Registrar to RPRA to be used in accordance with RPRA’s Use of Administrative Penalty Revenues Policy. RPRA will report on the use of settlement funds in its annual report.
